1. Agreement to Terms
By accessing or using KwaWingu (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users, including tour operators, their staff, agents, and guests accessing the guest portal.
2. Description of Service
KwaWingu provides a software-as-a-service platform for tour and activity operators, including reservation management, OTA distribution, operations tools, analytics, and related services. We do not operate tours, act as a travel agent, or assume responsibility for the tours listed on our platform.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and have the authority to bind your organisation to these terms.
4. Subscription & Billing
Paid plans are billed monthly or annually as selected. Prices are in USD unless otherwise stated. We may change pricing with 30 days' notice. Free trials do not require payment information. Refunds for annual plans are prorated for the unused portion.
5. Acceptable Use
You agree not to: use the Platform for illegal purposes; upload malicious code; attempt to access other users' data; resell or sublicense access without permission; use the Platform to send spam or unsolicited communications; or interfere with the Platform's operation.
6. Data Ownership
You retain ownership of all data you input into the Platform, including booking data, guest information, and business data. We claim no ownership over your content. You grant us a limited licence to process your data solely to provide the service.
7. Data Export
You may export your data at any time through the Platform's export features or by contacting support. Upon account termination, we will provide a reasonable period to export your data before deletion.
8. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors beyond our control.
9. Limitation of Liability
To the maximum extent permitted by law, KwaWingu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
10. Termination
Either party may terminate at any time. You can cancel your subscription through the Platform settings. We may terminate accounts that violate these terms. Upon termination, your right to use the Platform ceases, but data export provisions remain in effect.
11. Changes to Terms
We may update these terms with 30 days' notice via email or Platform notification. Continued use after changes constitutes acceptance.
